Use of Voxdigitals Services is subject to this Acceptable Use Policy or AUP (hereinafter referred to as “AUP”). This AUP is incorporated by this reference into the Terms of Service between you and Voxdigitals Technologies Pte Ltd (“Voxdigitals ”).

You agree to use the Voxdigitals Website or it’s Micro Portals (collectively, the “Services”) only for lawful purposes and that you are responsible for your use of and communications and content you post via its Micro Portals. You agree not to use the Services to offer any hardware or hardware/software combination of services for any unlawful purposes. You agree not to post on or transmit through this Website or its Micro Portals any unlawful, infringing, threatening, harassing, defamatory, vulgar, obscene, profane, indecent, offensive, hateful or otherwise objectionable material of any kind, including any material that encourages criminal conduct or conduct that would give rise to civil liability, infringes others’ intellectual property rights or otherwise violates any applicable local, state, national or international law. You agree not to use this Website or its Micro Portals in any manner that interferes with its normal operation or with any other user’s use and enjoyment of the Website or its Micro Portals.

You may not do any of the following while accessing or using its Micro Portals: (i) access, tamper with, or use non-public areas of its Micro Portals, our computer systems, or the technical delivery systems of our providers; (ii) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (iii) access or search or attempt to access or search its Micro Portals by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by us (and only pursuant to those terms and conditions), unless you have been specifically allowed to do so in a separate agreement with us; (iv) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or (v) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing its Micro Portals or Website, or by scripting the creation of content in such a manner as to interfere with or create an undue burden on its Micro Portals or Website.

Additionally, the following list gives examples of illegal, abusive, interfering or otherwise unacceptable or inappropriate behavior while using the Website or its Micro Portals.

Promoting or engaging in illegal or unlawful or prohibited or forbidden activities.

Using the Services in any manner that may subject Voxdigitals or any third party to liability, Damages or danger.

Using the Services in a manner that causes injury to person or property

Using the Services in any manner that violates any applicable third party policies or requirements that voxdigitals has communicated to you.

Using the Services in any manner that violates the Mobile Marketing Association guidelines and/or best practices, carrier guidelines, or any other industry standards.

Engaging in fraud with respect to your account, including using any caller ID functionality of the Services to misrepresent the identity of a caller.

Using your account to engage in fraudulent activity with respect to third parties or otherwise using your account to bypass phone identification systems such as those by classified advertising websites.

Using any of the voxdigitals Products or services or Properties or Intellectual Property other than as expressly permitted.

Attempting to bypass or break any security mechanism on any of the Services or using the Services in any other manner that poses a security or service risk to voxdigitals , to any user of our Services, or to any of our or their respective customers.

Testing or reverse-engineering the Services in order to find limitations, vulnerabilities or evade filtering capabilities.

Transmitting any material that may infringe the intellectual property rights or other rights of third parties, including but not limited to trademark, copyright or rights of publicity or otherwise violating, infringing, or misappropriating the rights of any third party.

Engaging in spamming or other unsolicited advertising, marketing or other activities, including, without limitation, any activities that violate the applicable anti-spamming laws and regulations under the applicable jurisdictions.

Using the Services in connection with any unsolicited or harassing messages (commercial or otherwise) including but not limited to unsolicited or unwanted phone calls SMS or text messages, voice mail, or faxes.

Using voxdigitals SMS in a manner that is not designed to enhance or augment the person-to-person nature of SMS communications.

Offering services that allow a user to connect with emergency services personnel or public safety answering points such as 911 or E911 services, unless specifically paid for and activated by voxdigitals .

Engaging in activities or transmitting through the Services any information that may be illegal, libelous or defamatory or otherwise malicious or harmful to any person or entity, or discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age.

Harvesting or otherwise collecting information about others, including email addresses or phone numbers, from voxdigitals website and its Micro Portals without their express consent.

Creating a false identity or forged email address or header, or phone number, or otherwise attempting to mislead others as to the identity of the sender or the origin of a message or phone call using your account.

Violating or facilitating the violation of any applicable laws in the applicable jurisdictions regarding the transmission of technical data or software, or the recording of telephone calls.

Interfering with or disrupting networks connected to the Services or violating the regulations, policies or procedures of such networks.

Improperly engaging in activity for which the United States Federal Communications Commission has restricted or regulated with regard to proper use of the public telephone network.

Using the Services, or a component of the Services, in a manner not authorized by Voxdigitals.

The following scenarios are intended to provide examples of acceptable and unacceptable uses of our resources and Services. These examples are not comprehensive but merely illustrations of some types of unacceptable use.

If you operate messaging services toward or in Singapore:You shall comply with all applicable laws or regulations in any country where message services are sent, marketed or provided.

a. If you operate messaging services toward or in Singapore:

Marketing messages toward Singapore telephone numbers, clients shall comply to the Singapore Do Not Call (DNC) provisions under the Singapore Personal Data Protection Act 2012 (PDPA) in application from 2 January 2014 and ensure that no marketing messages are sent to Singapore telephone numbers registered with the DNC Registry, and to the Moneylenders Act. The Singaporean Government has recently implemented a new legislation, which bans the marketing of Moneylenders via SMS. The new rules related to these marketing exclusions have been included in the existing Moneylenders Act and it specifically states, in section 2.2 (h) of the directive the following: “Notwithstanding paragraph 2.1, the following advertising channels are not permitted: Advertisements in the form of Short Message Service (SMS) messages and e-mails sent to the general public, patrons of the licensee or former patrons of the licensee.” For your convenience, the full directive can be obtained from here: https://www.mlaw.gov.sg/content/dam/minlaw/rom/Moneylenders/Directions%20_%20Moneylenders%20advertisements.pdf

b. If you operate in the EU, the following EU directives (or national implementations) have particular relevance:

   a. E-Privacy Directive: Directive 2002/58/EC
   b. Commerce Directive: Directive 2000/31/EC
   c. Data Protection Directive: Directive 95/46/EC
   d. Unfair Contract Terms Directive: Directive 93/13/EC
   c. If you operate in Australia the 2003 Spam Act applies.

The content displayed and/or processed through our Services shall not contain any of the following types of content:

   a. Content that infringes a third-party’s rights according to applicable law;
   b. Excessively profane content;
   c. Hate-related or violent content;
   d. Content advocating racial or ethnic intolerance;
   e. Content intended to advocate or advance computer hacking or cracking;
   f. Gambling;
   g. Other illegal activity, including without limitation illegal export of controlled substances or illegal software;
   h.Drug paraphernalia;
   i. Phishing;
   j. Malicious content;
  k. Other material, products or services that violate or encourage conduct that would violate any criminal laws, any other applicable laws, or any third-party rights;

In addition, you may not and may not allow any third-party, including your End Users, to:

Encourage any illegal, abusive, or other activities that interfere with our business or activities; Attempt to circumvent or break any security mechanism on any of the Services or use the Services in any manner that poses a security or other risk to us, any user of our Services, or any of our or their respective customers; Benchmark, tamper with, unauthorized test, reverse-engineer, decompile, or otherwise use the Services in order to find limitations or vulnerabilities or evade filtering capabilities, or any other purpose not authorized by us; Use the Services in any manner that may subject us or any third party to liability, damages, loss or danger; Launch or facilitate, whether intentionally or unintentionally, a denial of service attack on any of the Services or any other conduct that adversely impacts the availability, reliability, or stability of the Services; Transmit any material that contains viruses, trojan horses, worms or any other malicious, harmful, or deleterious programs; Use the Services in any manner that violates industry standards; any third party policies or requirements that we may communicate to our customers including any usage requirements; Use the Services in connection with any unsolicited or harassing messages (commercial or otherwise) including unsolicited or unwanted phone calls, SMS or text messages, voice mail, or faxes; Use the Services to harvest or otherwise collect information about others, including email addresses or phone numbers; Use the Services to engage in or in connection with fraudulent activity; Use the Services to transmit any material that infringes the intellectual property rights or other rights of third parties; Use the Services to transmit any material that is libelous, defamatory, discriminatory, or otherwise malicious or harmful to any person or entity; Create a false identity or forged email address or header, or phone number, or otherwise attempting to mislead others as to the identity of the sender or the origin of a message or phone call; Use the Services, or any component of the Services, in any manner not authorized by us;
